This memo aims to provide clarification regarding the witness confirmation process for client signatures on legal documents. Recently, there have been issues with documents not meeting the necessary requirements.
As per legal standards, a witness (usually the Representative, but it can be another person) is mandated to confirm the client’s signature on all documents. This confirmation can be done in person or remotely using videoconference.
It is crucial to ensure that, regardless of the method used, the client’s and the witness’s signatures are dated on the same day. Additionally, when multiple clients are involved, such as a joint client or spouse, their signature dates may differ, but the Representative’s (as the witness) signature date must always align with the date of the client signature they witnessed.
